Must read

Edet Ikotidem

Commissioner for Special Duties in Akwa Ibom State, Dr. Bassey Okon was recently relieved of his duty by the state government

This decision, announced on June 10,  2024, was officially communicated through a statement signed by Enobong Uwah, the Secretary to the State Government (SSG).

The announcement directed Dr. Okon to hand over his responsibilities and all government properties in his possession to the permanent secretary of the ministry

The precise reasons for Dr. Okon’s dismissal were not disclosed in the official statement. However, it was framed as part of a broader effort to “reposition the administration” to better align with Governor Eno’s A-R-I-S-E Agenda, a developmental blueprint for the state

Can One be Relieved of His Duty?

This agenda aims to enhance various aspects of governance and public service delivery in Akwa Ibom, suggesting that the reshuffle was intended to optimize the administration’s effectiveness in implementing these goals Governor Eno expressed gratitude to Dr. Okon for his service and wished him well in his future endeavors, indicating that the termination was a strategic administrative move rather than a punitive action

The lack of specific reasons has led to speculation, which is common in such political decisions, but no substantial evidence points to any misconduct or specific failures on Dr. Okon’s part.

The move aligns with similar administrative changes aimed at refreshing the executive team to ensure that the governor’s strategic objectives are met effectively

Why someone can be relieved of his duty

The decision to relieve someone of their duties is a serious matter that requires careful consideration and justification.

It involves terminating an individual’s employment or removing them from a position of responsibility, which can have significant repercussions for the person involved, the organization, and potentially the broader community.

There are several key reasons why someone might be relieved of their duties, and these reasons often intertwine with legal, ethical, and operational considerations.

A look at a comprehensive understanding of why such actions might be necessary.

  1. Incompetence or Poor Performance

One of the most common reasons for relieving someone of their duties is incompetence or consistently poor performance. When an employee or an official fails to meet the required standards or does not fulfill their responsibilities adequately, it can have detrimental effects on the organization’s efficiency and morale. Poor performance can manifest in various ways, such as:

  • Inability to Meet Deadlines: Constantly failing to complete tasks on time can delay projects and affect the overall productivity of the team or organization.
  • Substandard Quality of Work: Delivering work that is consistently below the expected standard can harm the organization’s reputation and lead to loss of clients or stakeholders’ trust.
  • Lack of Skills or Knowledge: Sometimes, an individual may lack the necessary skills or knowledge to perform their job effectively. This can be due to insufficient training, but if the individual is unable to improve despite support and training efforts, they may need to be relieved of their duties.
  1. Ethical Violations and Misconduct

Ethical violations and misconduct are serious offenses that can warrant immediate dismissal. These behaviors not only undermine the integrity of the individual but can also tarnish the reputation of the organization. Examples of ethical violations and misconduct include:

  • Fraud and Theft: Engaging in fraudulent activities or stealing from the organization or its clients is a clear breach of trust and legal standards.
  • Harassment and Discrimination: Any form of harassment, whether sexual, racial, or otherwise, as well as discriminatory practices, are intolerable and violate both ethical norms and legal regulations.
  • Conflicts of Interest: Failing to disclose conflicts of interest or engaging in activities that benefit the individual at the expense of the organization can lead to a loss of trust and credibility.
  1. Violation of Company Policies

Every organization has its set of policies and procedures designed to ensure smooth operations and maintain a professional environment. When an individual repeatedly violates these policies, it can disrupt the workplace and create a negative atmosphere. Some common policy violations include:

  • Repeated Absenteeism: Regularly missing work without valid reasons can strain colleagues who have to cover the additional workload and can disrupt team dynamics.
  • Substance Abuse: Coming to work under the influence of drugs or alcohol can endanger the individual and their coworkers, compromising safety and productivity.
  • Insubordination: Refusal to follow legitimate instructions from supervisors or displaying a consistent pattern of defiance can undermine authority and lead to chaos within the team.

  1. Criminal Behavior

Engaging in criminal behavior, whether within or outside the workplace, is a strong ground for relieving someone of their duties. Criminal activities reflect poorly on the individual’s character and can severely damage the organization’s reputation. Examples include:

  • Violence: Any form of violence, whether physical or verbal, directed at coworkers, clients, or anyone else, is unacceptable.
  • Illegal Activities: Involvement in illegal activities, such as drug trafficking, embezzlement, or insider trading, even if conducted outside work, can lead to dismissal due to the potential harm to the organization’s image and trustworthiness.
  1. Breach of Confidentiality

Many positions, particularly in fields like healthcare, law, finance, and technology, require individuals to handle sensitive and confidential information. Breaching this confidentiality can have serious legal and ethical implications. For instance:

  • Data Leaks: Unauthorized disclosure of private or proprietary information can lead to legal actions, financial losses, and a breach of client trust.
  • Insider Information: Using confidential information for personal gain or sharing it with unauthorized individuals can damage the organization’s competitive edge and lead to legal consequences.
  1. Health and Safety Concerns

Sometimes, an individual’s health or behavior may pose a risk to themselves or others in the workplace. Ensuring a safe working environment is paramount, and this might require relieving someone of their duties if:

  • Mental Health Issues: Severe mental health issues that remain untreated and pose a risk to the individual or coworkers might necessitate removal from duty until they can seek appropriate treatment.
  • Unsafe Practices: Consistently engaging in unsafe practices or disregarding safety protocols can lead to accidents and injuries, necessitating dismissal to protect the workforce.
  1. Organizational Restructuring and Redundancy

Relieving someone of their duties can also be a result of organizational restructuring or redundancy. This is often not a reflection of the individual’s performance but rather a strategic decision by the organization to adapt to changing market conditions or improve efficiency. Reasons include:

  • Mergers and Acquisitions: These often lead to overlapping roles and the need to eliminate redundant positions.
  • Technological Advancements: Automation and new technologies can render certain jobs obsolete, leading to layoffs.
  • Financial Constraints: Economic downturns or financial challenges may force organizations to downsize their workforce to remain viable.
  1. Personal Incompatibility

Personal incompatibility, or a mismatch between the individual and the organization’s culture, values, or team dynamics, can be another reason for dismissal. This includes:

  • Cultural Fit: An individual who does not align with the core values and culture of the organization may struggle to integrate and collaborate effectively.
  • Interpersonal Conflicts: Persistent conflicts with colleagues, especially if they disrupt team cohesion and productivity, might necessitate relieving the individual from their duties.

Legal and Ethical Considerations

When considering relieving someone of their duties, it is crucial to adhere to legal and ethical standards. This ensures that the decision is justified and defensible, and that the rights of the individual are respected. Key considerations include:

  • Due Process: Ensuring that the individual is given a fair chance to respond to allegations and improve their performance if possible.
  • Documentation: Keeping thorough records of incidents, warnings, and performance reviews to support the decision.
  • Equal Treatment: Ensuring that the decision is free from discrimination and bias, and that similar cases are treated consistently.

Impact on the Organization

Relieving someone of their duties can have various impacts on the organization, including:

  • Morale and Productivity: If handled poorly, it can demoralize remaining employees. Conversely, it can improve morale and productivity if it addresses significant issues affecting the team.
  • Reputation: Publicized dismissals, especially for ethical violations, can affect the organization’s reputation, either positively by demonstrating a commitment to integrity or negatively if perceived as unjust.
  • Financial Costs: There are often financial implications, including severance packages, legal fees, and the cost of recruiting and training a replacement.

Conclusion

Relieving someone of their duties is a complex decision that should be approached with careful consideration and respect for both the individual and the organization. It involves balancing performance standards, ethical conduct, and the broader impact on the workplace environment. By ensuring that such decisions are made fairly, transparently, and for justified reasons, organizations can maintain their integrity and continue to function effectively, while also upholding the dignity and rights of their employees.
